Activity Marketplace Terms

These terms apply when a guest submits an enquiry about an activity listed on the Refuje marketplace. They complement our main Terms & Conditions and Privacy Policy.

Activity Marketplace Terms

These Activity Marketplace Terms apply when a guest discovers, reviews, enquires about, or continues with a Marketplace / Provider Activity through Refuje, including through Refuje's website, QR-linked flows, hotel-linked guest journeys, stay tabs, concierge flows, or marketplace interfaces.

Capitalized terms such as Direct Refuje Booking, Hotel-Linked Guest Journey, and Marketplace / Provider Activity have the meanings described in Refuje's Terms & Conditions.

These Activity Marketplace Terms supplement Refuje's Terms & Conditions, Privacy Policy, and Cancellation / Refund / Rescheduling Policy where relevant.

If there is a conflict between these Activity Marketplace Terms and a more specific activity-specific, booking-specific, provider-specific, or hotel-specific term presented for the relevant activity, the more specific term will govern for that activity or transaction.

1. Refuje's Marketplace Role

Unless Refuje expressly states otherwise for a specific transaction, Refuje acts as a discovery, content, enquiry-routing, communication, and operational-tracking layer for Marketplace / Provider Activities.

Refuje is not the activity operator, guide, transporter, supervisor, merchant, payment collector, or booking-confirming party for independent provider activities unless Refuje expressly states otherwise for that specific activity or transaction.

The listed provider remains responsible for activity operation, staffing, guides, equipment, transport, permits, licences, insurance, safety, risk disclosure, suitability, final confirmation, pricing, taxes, cancellation and no-show terms, and delivery of the activity.

2. Enquiry, Not Confirmed Booking

Submitting or continuing with an enquiry through Refuje does not by itself create a confirmed booking.

Guests should not assume that availability, price, pickup, inclusions, suitability, payment, cancellation terms, or activity operation is confirmed until confirmed by the relevant provider, hotel, or Refuje where Refuje expressly acts as the booking-confirming party.

Final confirmation, customization, payment, cancellation, no-show treatment, and participation terms may be agreed directly between the guest and the provider or, where relevant, the hotel.

3. Contact Sharing And Provider Data Use

When a guest continues with a marketplace activity enquiry, Refuje may share enquiry data with the relevant provider, including guest name, phone or WhatsApp number, preferred date or time, group size, guest note, source hotel, activity name, and lead or enquiry reference.

Providers may use guest enquiry data only to respond to, coordinate, fulfil, support, or reconcile the specific enquiry or activity. Providers must not resell, reuse, remarket, spam, independently market to guests, disclose the data to unauthorized persons, or use it for unrelated purposes unless separately authorized by the guest and permitted by law.

Independent providers are responsible for their own handling, storage, use, deletion, security, and lawful processing of guest data after receiving it from Refuje.

To the maximum extent permitted by law, Refuje is not responsible for a provider's unauthorized, unlawful, or non-compliant use of guest data after lawful sharing for a marketplace enquiry, except to the extent caused directly by Refuje's own act or omission, breach of applicable law, breach of the Privacy Policy, or breach of these Activity Marketplace Terms.

Refuje may retain enquiry, communication, lead, attribution, support, issue-review, reconciliation, fraud-prevention, safety-review, and legal-compliance records.

4. Guest Responsibility Before Confirmation

Before confirming or participating in a Marketplace / Provider Activity, guests should verify all material details directly with the provider or hotel, including:

  • price and taxes;
  • inclusions and exclusions;
  • pickup, drop, meeting point, or route details;
  • duration and schedule;
  • cancellation, rescheduling, no-show, or late-arrival terms;
  • difficulty, physical effort, suitability, and age limits;
  • health, weather, fitness, altitude, terrain, transport, or equipment restrictions;
  • safety arrangements, guide arrangements, permits, insurance, or equipment requirements where relevant.

Guests are responsible for assessing whether the activity is suitable for their health, fitness, age, medical condition, risk tolerance, family, group, travel plans, and local conditions.

5. Risk Notice And Safety

Marketplace / Provider Activities may involve physical effort, outdoor exposure, weather, altitude, terrain, roads, transport, wildlife, water, equipment, local conditions, or other inherent risks. Those risks may not be fully eliminable.

The provider is responsible for explaining activity-specific risks, suitability, route or format changes, safety arrangements, and participation requirements.

Guests must disclose relevant medical, fitness, accessibility, allergy, dietary, or safety information where requested or where reasonably relevant to safe participation.

Where a minor participates, the parent or lawful guardian is responsible for assessing age suitability, providing or authorizing relevant safety information, and supervising the minor unless a specific activity expressly provides otherwise.

Guests must follow reasonable safety, conduct, timing, route, equipment, transport, and participation instructions given by the provider, guide, hotel, transport operator, or Refuje representative.

A provider, hotel, or Refuje may refuse, modify, pause, or stop participation where continuing would create safety, legal, operational, welfare, misconduct, late-arrival, health, suitability, property-risk, or local-condition concerns. Nothing in this section prevents reasonable emergency assistance where feasible.

6. Pricing, Payment, And Offline Transactions

In enquiry-first marketplace flows, payment may be collected offline by the provider or by the hotel.

Unless Refuje expressly states otherwise for a specific transaction, Refuje is not the merchant of record, payment collector, or payment guarantor for Marketplace / Provider Activities.

Prices shown by Refuje are intended to support discovery and enquiry. Final pricing, taxes, availability, payment method, inclusions, exclusions, and any changes should be confirmed directly with the provider or hotel before participation.

Refuje may retain transaction status, reported collector information, and outcome data for attribution, support, reconciliation, incident review, and legal compliance.

7. Cancellation, Refunds, And No-Shows

Refuje's Cancellation / Refund / Rescheduling Policy applies only to Direct Refuje Bookings and to transactions where Refuje expressly states that the policy governs.

For Marketplace / Provider Activities where Refuje only routes the enquiry and does not act as merchant, payment collector, or booking-confirming party, cancellation, refund, rescheduling, late-arrival, and no-show terms may be governed by the relevant provider, hotel, or third-party platform.

Guests should confirm cancellation, refund, rescheduling, late-arrival, and no-show rules directly with the provider or hotel before confirming participation or making payment.

8. Hotel-Sourced Discovery

Where a guest discovers an activity through a hotel-linked guest journey, stay tab, QR-linked page, guest-access page, concierge flow, or hotel-assisted Refuje experience:

  • the hotel may be the source of the lead;
  • the provider may still be an independent operator;
  • the provider remains responsible for operating the activity unless the hotel expressly undertakes that role;
  • Refuje may record the hotel source, enquiry status, and reported outcome for attribution, issue review, support, reconciliation, and legal purposes.

Discovery through a hotel-linked Refuje flow does not, by itself, make Refuje or the hotel the operator of the listed activity unless expressly stated.

If hotel staff directly confirms, sells, collects payment for, or operates the activity, the hotel's or provider's own terms will generally govern that transaction to the extent the hotel or provider controls the confirmation, payment, operation, cancellation, or delivery, unless Refuje expressly states otherwise.

9. Complaints, Misuse, And Safety Reporting

Guests should notify Refuje promptly if they experience or become aware of:

  • unsafe conduct;
  • misleading listing details;
  • provider misconduct;
  • contact misuse or guest-data misuse;
  • no response after enquiry;
  • price mismatch;
  • unauthorized guest-data use;
  • materially different delivery from the published listing;
  • discrimination, harassment, or abusive conduct;
  • payment or cancellation disputes;
  • any safety, injury, route, transport, weather, or operational concern.

Refuje may investigate, request further information, coordinate with the provider or hotel, review provider conduct, review listing quality, pause or remove listings, restrict marketplace participation, or take other reasonable steps where appropriate.

Where the transaction, payment, or activity operation is controlled by an independent provider, hotel, or third-party platform, Refuje does not guarantee resolution, refund, compensation, or provider performance.

10. Content, Listings, And Platform Rights

Refuje may update, edit, pause, remove, or restrict listings, providers, or marketplace features where Refuje reasonably believes that:

  • a listing is inaccurate, outdated, unsafe, or misleading;
  • a provider is non-compliant;
  • guest data is being misused;
  • content is unauthorized, infringing, or unlawful;
  • there is legal, reputational, operational, quality, data-use, or safety risk.

Refuje does not guarantee that any particular activity listing will remain available, unchanged, continuously visible, or continuously accurate after publication.

Nothing in this section permits Refuje to knowingly maintain listings that it determines to be materially unsafe, unlawful, or misleading.

11. Disclaimer And Limitation Of Liability

To the maximum extent permitted by law, Refuje provides the marketplace, discovery, content, enquiry-routing, communication, and operational-tracking layer on an "as available" and "as is" basis.

Refuje does not guarantee:

  • that an enquiry will convert into a booking;
  • that a provider or hotel will accept, respond to, or honour every enquiry;
  • that final pricing, availability, pickup, inclusions, exclusions, route, or timing will remain unchanged until confirmed;
  • that every listing remains continuously accurate despite later changes by the provider or local conditions;
  • that a provider, hotel, or third-party operator will issue invoices, GST invoices, receipts, credit notes, refund documents, or tax records unless Refuje expressly states that it is responsible for doing so;
  • that third-party messaging, payment, invoicing, receipt issuance, tax documentation, transport, provider, hotel, or operational systems will always function without interruption or error.

To the maximum extent permitted by law, Refuje is not responsible for injury, loss, delay, cancellation, misconduct, negligence, non-performance, payment dispute, data misuse, safety issue, or other acts or omissions of an independent provider, hotel, transport operator, guide, vendor, or other third party, except to the extent caused directly by Refuje's own act or omission, breach of applicable law, or breach of these Activity Marketplace Terms.

Nothing in these Activity Marketplace Terms limits any liability or user right that cannot legally be limited or excluded under applicable law. Any liability cap or exclusion in these Activity Marketplace Terms applies only to the extent permitted by applicable law.

12. Governing Law And Jurisdiction

These Activity Marketplace Terms shall be governed by the laws of India.

Subject to mandatory legal requirements, consumer protection rights, and any forum that cannot lawfully be excluded, the courts at Shimla, Himachal Pradesh, India shall have jurisdiction over disputes arising out of or relating to these Activity Marketplace Terms.

14. Updates To These Terms

Refuje may update these Activity Marketplace Terms from time to time to reflect legal, operational, product, marketplace, provider, safety, data-use, or risk-related changes.

Material updates may be posted on the website or communicated through appropriate channels. The latest current version published by Refuje will govern from its effective date.
